Please read these terms carefully before using WriteMate's services. By accessing or using our platform, you agree to be bound by these terms.

1. Overview

Welcome to WriteMate ("we," "our," or "us"). By using our website, platform, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and WriteMate regarding your use of the Services.

Our Services include AI-powered content generation tools, image creation capabilities, and other related features designed to assist with content creation and workflow optimization. By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, you must not access or use our Services. We may modify these Terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of the Services means you accept the modified Terms.

2. Account Terms

To access certain features of WriteMate, you may be required to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update such information as necessary to keep it accurate, current, and complete.

You are solely responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account or other security breaches
  • Ensuring that you exit from your account at the end of each session

We reserve the right to terminate accounts, in our sole discretion, for any reason, including but not limited to violation of these Terms. You may cancel your account at any time through your account settings or by contacting our support team.

3. Usage Rights

Subject to these Terms, WriteMate grants you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for your personal or internal business purposes. You may not:

  • Use the Services for any illegal purpose or in violation of any local, state, national, or international law
  • Attempt to gain unauthorized access to any portion of the Services or any other systems or networks connected to the Services
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without express written permission from WriteMate
  • Use the Services to generate content that is harmful, abusive, racially or ethnically offensive, vulgar, sexually explicit, defamatory, infringing, invasive of personal privacy or publicity rights, or otherwise objectionable
  • Use automated means, including spiders, robots, crawlers, data mining tools, or the like to download or scrape data from the Services
  • Interfere with or disrupt the Services or servers or networks connected to the Services

We reserve the right to monitor your usage of the Services and to suspend or terminate your access if we believe you are violating these Terms.

4. Content Ownership

You retain all rights to the content you create using our Services ("User Content"). By using our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content solely for the purpose of providing and improving our Services.

You represent and warrant that:

  • You own or have the necessary rights to the User Content you submit through our Services
  • Your User Content does not violate the privacy rights, publicity rights, intellectual property rights, or any other rights of any person
  • Your User Content does not contain material that is false, intentionally misleading, or defamatory

WriteMate does not claim ownership of your User Content. However, we own all rights to the Services themselves, including all intellectual property rights associated with the Services and any content created by WriteMate.

5. Payment Terms

Some features of our Services may require payment. All fees are in US dollars and are non-refundable except as required by law or as explicitly stated in these Terms.

By subscribing to a paid plan, you agree to:

  • Provide current, complete, and accurate billing information
  • Promptly update your billing information if it changes
  • Pay all charges at the prices then in effect for your subscription
  • Continue to pay for your subscription until you cancel it

We may change the fees for our Services at any time. If we increase fees for a subscription you already have, we will notify you at least 30 days in advance. If you do not cancel your subscription, you will be charged the new fees upon your next billing cycle.

We use third-party payment processors to bill you through a payment account linked to your account. The processing of payments will be subject to the terms, conditions, and privacy policies of our payment processors in addition to these Terms.

6. Cancellation

You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation:

  • Your subscription will remain active until the end of your current billing period
  • You will not receive a refund for any unused portion of your current billing period
  • You will lose access to premium features when your subscription expires

We reserve the right to cancel or suspend your account or subscription at any time for any reason, including but not limited to violation of these Terms. If we cancel or suspend your account for a violation of these Terms, you may not receive a refund.

7. Limitation of Liability

To the maximum extent permitted by law, WriteMate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content

Our liability is limited to the maximum extent permitted by law, and under no circumstance will our aggregate liability to you exceed the amount you have paid to WriteMate in the past six months for the Services.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

8. Changes to Terms

We may modify these Terms at any time, in our sole discretion. If we do so, we will update the "Last Updated" date at the beginning of these Terms. We will notify you of material changes by posting a notice on our website or sending you an email. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

We encourage you to review these Terms frequently to stay informed about our legal terms. If you do not agree to the new terms, you should stop using the Services and cancel your subscription.
